GF, I think making recess appointments is vastly different than using the so-called "nuclear option" to pass legislation over the wishes of the American people and in contravention to Senate protocol. As you will recall there was a lot of pressure on the GOP when they controlled the Senate to use the point of order to stop a Dem filibuster of judicial nominations. They declined to do so despite the obstructionism of Dems because they obviously did not want to provide the precedent that would come back to haunt them. We then got the "compromise" of the Gang of 14 which in my view was a travesty.

Having said all that, using this option to stop the filibuster of judicial nominations is vastly less egregious than using it to bypass the longstanding right of the minority to impact legislation through the cloture vote.
