My personal opinion, the odds are against National Coal of Alabama returning with another application to mine the Brushy Pond area. National Coal's problem, their inability to provide the Alabama Surface Mining Commission with required documentation, as an example, permits from ADEM, Army Corps of Engineers just to name a few. The public interest in this permit application was at a level where the Alabama Surface Mining Commission (ASMC) was under the microscope as it relates to "doting the "I's" and crossing the "T's". With the number of reported mine violations accumulated by National Coal of Alabama being made public, (over 9,000) serious questions were being asking about the level of enforcement by the regulating agencies. I think one can connect the dots and see this is a classic case of watching a bad idea snowball into an uncontrollable disaster. With the passing of time National Coal's ability to stonewall the process deteriorated to a point where cooperation from the regulatory agencies all but disappeared. In this case the system worked - the public exercised it's right to participate in the process and prevailed!
