Well, to my surprise, and probably to a lot of you too, the levels at Alabama Power's Lake Smith have returned to a normal level once again. I just wonder if this is the result of all the recent rain we've experienced, or does it have anything to do with SLISA scaring APCO into allowing the lake level to rise? I just hope that slisa disbands itself, before APCO decides to make us all remove our docks from their lake!

Do I sense some sarcasm that the lake level is 495.5 and we've had a lot of rain. Wait until July and extreme summer temperatures and see what happens if an agreement of some type on minimum water level is not reached.
As far as removing all boat docks from Smith Lake, Alabama Power is not that dumb nor do they have this level of control over existing docks. They may elect to restrict new docks installations in the future but I doubt this. Young people are experiencing levels of recreation that their parents and grandparent could not enjoy. Smith lake will continue to be developed until public sentiment is that the lake is too crowed and they will see that this is not a good investment.
The Boston tea party would seem like a day in the park if removal actions were attempted. Public sentiment would be somehing that they would never hope to ever see. I don't think that this country has enough federal judges to hear all the law suits that would be initiated.

Why would a judge want to listen to a case that has no merit? If they own the property I would think they could kick anyone out that they wanted to. Perhaps they'd have to refund part of the permit fee, but I doubt they could be 'forced' to allow access to their own property.

How many lawsuits have we all seen that we thought were frivulous?
1. Hot coffee at McDonalds!
2. Illegial immigrants suing for the right to vote in this country!
3. Border patrol agents in prison after shooting a drug smuggler!
4. Convictions being overturned because the accused came into court with handcuffs!.
5. Death penalties being overturned because of a claim of "cruel" punishment.
6. Shooting an armed intruder in your own home!
On and on. Every corporation wants to maintain a good image with the public. Politicians also want good repore with their constituents. So, why would Alabama Power want to suddenly outlaw boat docks on Smith Lake? This would be a disaster for the tax base for the three counties surrounding Smith Lake and a public relations nightmare for Alabama Power.
If Alabama Power own Smith Lake outright, then why do they need a permit from FERC? This permit has parts other than power generation (social responsibiliity, environmental, etc.) that are considered prior to the permit being issued. This is a situation where ther needs to be and can be a "win-win" for everybody.

Of course not, there's no basis for one.... That was my point!
There is NO POINT for slisa's stance on water levels at Lewis Smith, or any other lake, for that matter.
If slisa would have taken the "Friendly" approach, and ASKED for consideration on APCO's part, I could understand it, but NOT the "Hard-line" tactics they've been using. Quite frankly, if I were running APCO, I would have told slisa to take a hike a long time ago!(And not in those nice words!) Plus let's get back to the REAL ISSUE:
ALL THAT "SEASONAL" LAND THAT'S OWNED BY A SELECT FEW INDIVIDUALS THAT ARE TRYING TO BECOME EVEN RICHER THAN THEY ALREADY ARE. That's the main concern of slisa; Always has been, always will be.

Hello All
I would first like to say that I think everyone has the right to their opinion,
even slisasucks. However, opnions must yield to facts. The first fact is that waterph is not Jared Key. I would like to thank waterph for his (or her) defense of the truth. I would like to challange slisasucks to a public forum where all sides from SLISA to APC and everyone in between can represent their sides and present the facts. Slisasucks continues to want answers and I'm willing to answer every question as long as you are willing to do the same. The other fact is that between 1962-1972 that Smith Lake level in mid september was near the 502' msl and between 1973-2006 the level mid September is near the 497' msl. That 5' difference is contributed to cooling water supplied to the addition of unit #10 at the Gorgas Steam Plant. I am willing to talk to anyone and provide privately or publically the documentation to back up anything that I say.

Answer this question... I'm living out of state right now visiting 2 a year right now until October. I watch the weather regularly though and noticed a lot of rain has been falling. Generally I see the lake go up an inch or .1 foot every rain day. Until this past month. It's rained 5 days straight according to the weather listings and the lake goes up an inch down 2 up and inch down an inch. Why can't we get that level up to 515 and keep that water as a reserve for the drought.

A good question witha complicated answer. The truth is between the 510-488 APC has leeway with FERC on where they can maintain the water level. However, above the 510 they have no leeway. There is a manual that the Army Corps wrote back in 1965 that dictates what they must do above the 510. Above the 510 is considered flood stage and depending on the downstream gage at Cordova, Al , Smith Lake must either hold water to keep downstream from flooding or release water toget below flood stage. I will be happy top send you a link where the technical definition explains all the above in a more detailed manner if you like.
