Grand jury to review accident
Criminal charges advance in August boat fatality

The case of a boating accident in August that led to one fatality on Lake Martin will be presented to an Elmore County Grand Jury this week, according to officials with district attorney Randall V. Houston’s office and the Alabama Marine Police.

The grand jury will decide, later this week, whether or not to indict Patrick Leigh Cumbie, of Montgomery, on the charge of homicide by vessel, according to Jenny Hamilton, communications coordinator for Houston’s office.

Hamilton said additional information on the case could not be released until after the grand jury process was over.

“If a person is indicted, they have to be served that indictment before any additional information can be released,” Hamilton said.

The charge Cumbie is facing stems from a two-boat accident on Aug. 8, which led to the death of 62-year-old Edwin Donald Tatum of Prattville. Four others were injured in the accident. Cumbie was arrested and charged with boating under the influence and homicide by vessel in August, as a result of the accident.

Hamilton said if Cumbie is indicted on the charge of homicide by vessel, he could also face additional indictments as well.

“The grand jury could choose to find other indictments,” Hamilton said.

Alabama Marine Police Capt. Matt Brooks said the grand jury process is the next step in the case.

“If they indict him than a trial date will be set,” Brooks said. “If they don’t, it ends the criminal process.”

I feel sorry for all of the parties involved and impacted by this horrible accident. I do think that a murder charge is too harsh. If it were my family I am sure I would feel different but this was an accident.

I for one agree with the homicide charge since there was a BUI involved that makes it not an accident. A very long jail sentence is due.

The charge was Homicide by Vessel. They are two completely different charges with different penalties. Maybe you would feel differently if it had been your loved ones killed or injured.

If you would read my post it states exactly that. I feel sympathy for the victims and their families and hope that I never have to deal with anything even close to this devastating.

I can assure you that there will be one less person drinking and driving a boat on Lake Martin as a result of this most tragic event.

I misinterpreted your comment. You were saying that you felt murder was too harsh to go with, so homicide by vessel was appropriate. I also inconveniently overlooked your statement about if it had been your family. I think my fingertips moved faster than my brain in my reply. Please accept my apology.

I do accept and extend an apology to you.

As horrible as that accident was I do think that other lives will be saved and less will be injured after having such a trajic accident happen here on our lake. I hope that everyone will continue to remember this as well as the others that have lost their lives on our lake and others.
